What is court-connected custody and placement mediation?

Court-connected custody and placement mediation is a process used in Wisconsin family cases to help parents resolve disputes concerning legal custody or physical placement without asking the court to decide the dispute immediately.

The mediator is neutral. The goal is to help the parents identify areas of disagreement, discuss possible parenting arrangements, and determine whether they can reach a voluntary agreement consistent with the child’s needs. The mediator does not represent either parent and does not decide the case.

If the parents reach agreement, the terms are generally reduced to writing and submitted through the appropriate court process. The court retains responsibility for approving custody and placement arrangements under the applicable best-interests standard.

Mediation may be inappropriate or excused in circumstances involving domestic abuse, safety concerns, or other circumstances identified by statute or local procedure. Procedures and fee arrangements can vary by county.
